Your
community is actively involved in architectural control.
Article VII of the Declaration of Covenants and
Restrictions provides Association oversight over new and
modified construction of the following:
Plans should
be submitted to the Architectural Review Board ("ARB"),
in writing. Once reviewed, the ARB will issue written
acceptance or rejection of the proposed plans. Decisions
by the ARB are due within 45 days from the date they are
submitted. If new information is needed, the decision is
due within 45 days of the receipt of the new
information. It can approve, disapprove, or approve in
part the submitted plans. A failure to make a decision
within the applicable 45 day period will result in
automatic approval.
The
Declaration of Covenants and Restrictions provides that
"no work shall proceed except in strict compliance with
the approval requirements by the ARB set forth herein,
and any improvements or work performed without such
approval may be required to be removed by the Board."
All decisions by the ARB are to be submitted to the
Board of Directors of the Association.
Also, any
party aggrieved by a decision of the ARB shall have the
right to make a written request to the Board of
Directors of the Association, within 45 days of any
decision.
The
Association can make a schedule of reasonable fees for
processing ARB requests. The Architectural Planning
Criteria contained within the Declaration are
"guidelines" which can be waived by the ARB.
The ARB is
made up of three community residents. In addition to
reviewing plans submitted by residents, the ARB has the
power to recommend to the Board of Directors, amendments
to the Association's Architectural Planning Criteria.

proposal, and all other pertinent information. The ARB
may require submission of specific plans.
